How can I appeal an SSI and/or SSD benefits initial denial?

           If you want to appeal an SSI or SSD denial, you can request reconsideration. Your written SSI/SSD denial should tell you:

  1. Why you were denied.
  2. How to request reconsideration.
  3. Your deadline for appealing the denial.

What if I did not receive a written denial?

           Everyone has a right to appeal a denial and to a written decision. If anyone tries to discourage you from appealing, you should insist that you wish to appeal.

How can I appeal my written SSI/SSD denial?

           The best way to appeal any Social Security Administration denial is to go in person to your local Social Security office. A claims representative will help you fill out the request for a hearing and tell you what, if any, other papers you need to bring in. You should be given a receipt showing that you appealed and the date of the appeal. Keep this receipt with your other important Social Security papers.

What if I cannot appeal in person?

           If you cannot appeal in person, you can contact your local Social Security office and ask that hearing forms be mailed to you. However, we suggest you do this only if you cannot possibly appeal in person. We give you this advice because appeal papers can get lost or delayed in the mail.
