New Disability, Divorce, SSI and Medicaid Manual
The Public School's Special Education System as an Assistive Technology Funding Source - a comprehensive treatise on the rights of students with disabilities under the IDEA and section 504 - Although this booklet is published to reach a primary audience of attorneys and advocates who assist persons with disabilities who need AT to succeed in their public school experience, the publication should also be viewed as a comprehensive treatise on the rights of students with disabilities under the IDEA and section 504. Since so much of AT-related advocacy will deal with core special education law concepts, we go through all the core issues in great detail, referencing the federal law and regulations, case law, and federal policy letters as relevant. In each section, we analyze how the concepts discussed have implications for AT advocacy. In the AT-specific sections of this booklet (see section III.), our analysis is very comprehensive, referencing nearly every policy letter to come out of the U.S. Department of Education that specifically relates to AT. | Selected ADA/504 Cases Updated for the Supreme Court & Circuit Courts of Appeals Most of the listed decisions now include a synopsis of the case. Our synopsis is necessarily limited to the major holding of the case as best we can discern it and is often a pasted copy of the court's synopsis or conclusion. Many of these decisions contain detailed analysis of that particular circuit's interpretation of the ADA/504. It is, therefore, advisable to read as many of your circuit's decisions as possible to get an understanding of how your circuit views the law. |
