Ms. T, a sixty year old late stage cancer patient, wanted to divorce her husband who had moved out years before. Her two adult daughters live with her in a home she owns in her name alone. If she is still married when she dies, her husband, rather than her daughters, would inherit her home, regardless of what she put in a will. Divorce was her only means to being able to leave her property to her daughters free of claims from her husband. A divorce was commenced by a Neighborhood Legal Services, Inc. attorney working under the NYS Department of Health Cancer Grant.  Ms. T took a turn for the worse, and was placed on life support, vowing to her daughters that she would live to complete the divorce. Ms. T's NLS attorney pushed the divorce through as soon as possible, alerting the court personnel as to its urgency. Ms. T's condition improved, she was removed from life support and placed in a regular hospital room and then was able to go home.  Her divorce was finalized after she got off life support but before she was released from the hospital.

Ms. C. has been a public housing tenant for 10 years.  She is disabled and is on a fixed income.  She contacted NLS due to issues surrounding the calculation of her rent by the public housing authority.  She faced eviction and was concerned that the public housing authority was overcharging her an amount of rent that she cannot afford.  After a lot of negotiations, we were able to get the public housing authority to reduce her rent based on her income and agree to a reasonable payment plan for the remaining arrears so that Ms. C. can remain in her home.

Mr. R, who had been dislocated by a fire and who was living in a private room by relying on temporary housing assistance provided by the Niagara County Department of Social Services. The Department sought to discontinue the client's temporary housing assistance and transfer them to a group shelter with only 24 hours-notice and then attempted to sanction the client for failing to immediately accept the transfer. The client suffered from a documented mental condition and was seriously concerned about being placed in a group environment with little privacy. NLS represented the client at two fair hearings and successfully prevented the client from being transferred or sanctioned and the Administrative Law Judge ruled that 24 hours-notice was inadequate, that the Department had to do a thorough mental health assessment and that a plan individualized and tailored to the client=s needs had to be drafted by the Department.

Comunity Legal Education: In the first eleven months of 2016 NLS delivered 65 community legal education training sessions, either stand-alone seminars or as part of a program or conference. There were 2,195 people, including pro bono lawyers, legal services advocates, community agency social workers, case managers and clients that attended these trainings.  These events included training sessions on work incentives, fair housing and housing discrimination, landlord & tenant issues, special education, domestic violence, and other topics of interest to the low income and disabled populations.”
